He has now come out and said that what she told the Independent adviser is untrue.
The PM's independent adviser has investigated the allegations made against her and found them to be true.
He has written a report about his allegations, the contents of which are now public knowledge.
Sir Phil and his legal advisers will have the right to access to that report as part of his case.
Sir Phil does not appear to be the sort of man who is going to do a deal just so the government doesn't have to appear at an industrial tribunal, especially as he has had to give up his job because of her, and has now accused her of lying.
This little issue is not over yet for sure.
