Police kept evidence from jurors in a case which led to an innocent man spending 17 years in prison for a rape he did not commit, judges have ruled.

Yes police held back evidence it’s an absolutely incredible case.
They did it in the. Kiscko case in the 70s, when Castree was the real killer

Have you read the book Faze fuz. Lots of information in there that is not common knowledge
 
I agree that the system is not 'bent', unfortunately like all human based systems there are people within it that are not entirely honest.

However, if all of the points that you put above re juries, full disclosure, defence get everything and more how do we still continue to have miscarriages of justice?

I really do not beleive in the death sentence. One innocent man being hanged does not make up for all of the guilty who could/should be killed.

No matter how much you may think that Huntley etc deserve the death penalty, you have to ask yourself how many innocent people you are willing to kill to ensure this happens.
 
I said it on the other thread, but execution costs in California are c. $308m a pop. That’s pays for a lot of porridge. To save the likes of Andrew Malkinson, I’m happy to stick with the status quo.

I think that figure is a little misleading, in that those are running costs of death row facilities, rather than the cost of an execution, and it is based on the fact that California have only executed 13 inmates in that time period, so it means all the others have been kept in jail for many years, so the costs are actually attributed to porridge time.

I’ve read two of the Secret Barrister books. Calling the system bent is way over the top. There are many chances of mistakes and misjudgments to happen, as the system is people based and people are unreliable.

I'm absolutely against hanging, but unless I'm missing something Andrew Malkinson isn't a good example to use against it as rape wasn't a crime which had the death penalty as a punishment. Well not for about 200 years anyway. He would never have been hanged for the false charges against him.
It's a good example because he was wrongly convicted. There's no change in the burden of proof between murder and rape. If you can be wrongly convicted of one you can be wrongly convicted of another.

Doesn't really matter if it was a crime that's ever had the death penalty as punishment. It's the point that you can never be 100% certain everyone you convict is guilty.

The trouble with that is, you can't bring back the death penalty only for the few people that you think "really" deserve it. You either have it on the books or you don't.

And as has been shown in every country that's ever had the death penalty, it always ends up with some totally innocent people being put to death.

There's a moratorium on capital punishment in California. Nobody has been executed in 17 years, so that $308m figure is made up nonsense.

It’s about the police manipulating evidence though in order to get a conviction that’s the point and it’s far from an isolated incident.

This case is particular chilling as they knew the attacker had been physically scarred by his victim but they chose to convict anyway.

hang on a min - I have some sympathy with your broader point (esp having being falsely arrested and faced sneering magistrates) but let’s be fair. My friend is a magistrate and another is a court of appeal judge. I would trust them as much as anyone else close to me.


in other news - it may be worth reflecting on which countries have the death penalty these days. Are we really in that community?
Actually, just thinking about that a bit…..😂😂
