Novak wins his appeal Good Luck with the crowds

... but he complied with their requirements which is why the judge had no option but to side with him.

From what I've managed to read so far the judge said he hadn't been given enough time between having his visa frozen(?) and having his visa revoked.

Apparently there was a legal process to follow and the authorities didn't do it properly.

He has been released on a technicality - whether he has fully complied with the vaccine regulations hasn't, as far as I'm aware, been discussed in court.

Australian government withdrew their case.
It has been reported they had concerns that if they lost on the grounds the border staff had been unreasonable (apparently he was told on arrival there would be time to consult his legal team before being refused entry, but they then expedited the process before he had that consultation) that it would set a precedent for other people refused entry to claim they had been treated unreasonably.

They also noted that, ultimately, they still held the right to withdraw his visa at any time & deport him.

Judge said there is a difference to being refused entry & deported. Refused entry, can return after 12 months but deported it is 3 years.

I don't know much about Aussie public opinion. Is it predictable that he will be booed all the time he is on court? Only there seems to be a lot of anti-vax/anti-lockdown sentiment in Victoria (if the media are anything to go by), and also supportive eastern European communities adding to the mix.

I think at this stage after they lost the court case it would look bad for them to try and deport him. At this stage it would look like he was being singled out because of his profile and look like a witch hunt. I think at this stage the best option is let him in and let the crowds and the press vilify him and hope he flubs the tournament. Objectively if he has had covid within recent times he isnt a risk to them anyway surely?! And given that hes unvaccinated he probably has had it! The whole situation stinks but i think the government have to be careful now not to do anything that makes him look like a victim!

The Eastern European "community" normally end up fighting each other at the tennis in Melbourne. I can see this situation inflaming the situation.

Rather irritating that the right wing stations here in NZ view Nigel Farage as some kind of significance. Its a poir relection of this country's ignorance on such matters but hes just been on the radio spouting complete shyte.

Farage basically has an entire cottage industry of inserting himself into situations that have nothing to do with him and trying to make it all about him. See also - ludicrous gold lift photo with Trump.

Suppose the counter argument to that is if he really should be sent packing does it set an awkward precedent and look like he's only "got away with it" because of who he is? Rock and a hard place.

Very much depends on audience selection.
I expect there'll be a huge turnout of his supporters who'll be very very vocal and they may well drown out any opposition.
That's if he makes it to the tennis court.

People should stop busting Novax’s chops….look…he’s a very clever guy and has his reasons for refusing the vax…..and he knows science, so, you know, who can question his choice? The guy is absolutely not stupid……no siree….. I mean everybody knows that water responds to our emotions, right? Rigghhhttt?

And people say antivaxxers don’t understand science…..🤷🏻‍♂️

My understanding too - the crux of the matter is having had the virus is not something that clears non Aus residents from the visa regulations.
Off on a technicality which will soon be corrected I expect.

If Djokovic does get to play in the Australian Open, I actually hope he doesn't get booed TOO much. A lot of this isn't his fault IMO. (Clearly Djokovic has some daft anti-vax views, and those haven't (and shouldnt have) done him any favours) - I guess for that alone he'll be copping some booing.

However, he's a professional tennis player though, so you can't really blame him for trying to travel to play in the tournament - having gained the exemption from Tennis Australia.

I might be wrong, but it seems to be to do with politicians (Aussie PM) too, seeing the public outrage at Djokovic's medical exemption, and trying to close the stable door after the horse has bolted (as it were), to gain some public credit.

One does wonder if we ever find out which Boro players haven't been vaccinated wether they would receive the same vitriol this singular Serbian tennis player has?

How ridiculous.
Where to start.

How many Boro players are known right across the world.
How many Boro players are trying to get a Visa in Australia
How many Boro players want one more win to become the most successful player in the history of their sport.
Etc Etc Etc.

That would presumably depend if they were expecting not to have to follow the same rules as everyone else or not because of who they were I guess.

Why start your reply with "How ridiculous"? It hardly helps the debate.

I'm very much pro-vaccine. However in response to your points, I don't really see the exact significance of the second two?

Point one, I agree that Djokovic is a much bigger role model than any Boro player. However, him trying to get a visa in to Australia is do do his job as a tennis player. One can hardly blame him for that if he's gone through the correct process. That leads on to the third point, what does him wanting to win his 21st Grand Slam, and become the most successful player ever have to do with it? Of course he wants that. He's been working his whole life towards it.
