One woman was told it was her fault that her car was damaged/written off (WTF).
But why is nobody claiming from the insurance of the car park owners? Or , if they know which car the fire started from, why not claim the insurers of that car.
I don't understand any of this.
 
Don't know for sure but presume;

Usually car park owners insure the car park
Car owners insure their car
Most car parks say left at own risk and you need to be insured for eventualities. E.g if car gets window smashed while away etc

If it's like house insurance it's only someone else's negligence that means you claim against them

Eg if you live in a flat and person above you gets a leak and floods your bathroom, it's your insurance you claim off.

If you tell them your ceiling is dripping and they say they'll sort it and don't, then you claim against them because their negligence caused it
 
I think that car owners claim against their own insurance for the damage or loss of their car, and after the insurer has paid out they would be subrogated the rights of any recourse - which means that they can in turn claim against the car park and/or guilty car to recover the losses that they have paid out.

But, say for example, I parked next to a car which then caught fire. The fire spreads to my car, surely I would claim off the insurers of the other car?

this is when an insurance company actually does work for the money they take. For their financial benefit. Not yours.

you claim on your insurance always, it's your insurers that then have to counter claim. That's why you are always advised to not accept responsibility
 
I have recently discovered that if you drive into a flood, that's your fault but if a truck creates a bow wave and wipes you out coming the other way they will pay out straight away

Next time the fire starter gets an insurance quote will be fun.
Any accidents or claims in last 5 years? Yes
How much was that for? Err just £1.5million....
 
The pay-out offered to her is £13,000 less than she paid for her car.

Cath, who bought the car for £20,000 seven years ago and has been offered a £7,000 pay-out.

WTF does she expect after 7 years ?

It’s an heirloom though, I’m sure most insurance policies have sentimental coverage don’t they 🤦🏼‍♂️

Correct. The technical term is subrogation, just in case anyone has the slightest bit of interest.
