Is our club a Phoenix club?

It sort of is isn't it? Since it was renamed and rebadged, 1986 and all that.

I suppose the one thing that makes it debatable is the fact the league didn't eject us.

It's the same continiously existing club, so no.
A phoenix club is by definition a new club created to carry on from a defunct one.

But remember we were eventually able to drop 1986 and return to our historic birthdate again. It was something Steve Gibson was really keen to do.

Yes good point. So we were a phoenix club for a bit but then not anymore? Isn't that the case with a few of them though. Wimbledon, Darlo etc? They've all dropped the phoenix 'additions' to their name?

New date though, and new name. Sort of it is isn't it? Or certainly nearly is, on the cusp.

Plenty of clubs have changed their actual name, rather than the name of the company, without ceasing to exist.

- Swansea Town became Swansea City
- Small Heath Alliance became Birmingham City
- Newton Heath became Manchester United

We went from Middlesbrough to Middlesbrough.

The date change wasn't an enforced decision either, it was surely just a daft internal choice, clubs don't need their founding date on their badge.

Well indeed, but ours was forced as a result of almost ceasing to exist.

I suppose the answer is no but when we had the old 1986 badge it probably wasn't so clear cut.

Not sure, the date change of the official club/company was enforced though 'Middlesbrough Football and Athletic Club 1986'.

No. We’re not a phoenix club. If we were, we would have had to start at the bottom of the pyramid. Not even a case of a club taking another’s registration. We kept our league status and started the 86 season as original Middlesbrough. Cant have two different clubs with one registration which is what it would of had to be if we were a phoenix club. We were just had a confusing and inaccurate badge for 20 years. Was better than the one we have now though.

Have we got the same company number? Once the club was incorporated it became indistinguishable from the company. It acquired legal personage. As I understand it, if the company is liquidated the club ceases to exist - there is no separate entity to survive.

By todays rules maybe but back then i dont think so. Wolves had done a similar thing i think and we were being made an example of. The Moskowitz, Gibson, Henderson, consortium badically bought a dead company and paid off its debts to keep the club alive. Survived liquidation is always whats used. We weren’t liquidated or there would be no club as we know it. Henderson was chairman so who knows about the badge

To be fair, an unsightly smudge on the porcelain after a nasty bout of gut rot is better than our current badge.

Bit harsh. Its a bit liverpool. Would have the three ships, simple lion and MFC or what we had with 1876. Will be a while before we change it. Crazy when you think we’ve had that badge for like 13 years
