Civil Enforcement Parking Notice Charge

Its for the small car park near/ opposite Tesco in Ingleby Barwick.

I dont go there often and didnt notice a sign, so I've ended up out staying the 30 min limit by the looks of it.

My question is, is this legit and enforceable?

I can remember many moons ago a lot of noise around the cinema car park in Boro dishing out tickets and everyone ignoring them with no real comeback?

If its a parking management company and not local authority then you have been charged for a breach of contract. Plenty on MSE on how to not pay basically, including letter templates. The short of it is that you need to tell them you are the registered keeper, but don't say who was driving.

If you ignore it, you'll end up getting letters off debt collection companies.

No reference to the local authority on the Notice, so assume its a parking management company.

Sorry for sounding ignorant, but whats MSE?

Thanks

There's groups that will fight it for you for £15

Or you can follow the steps yourself for free

One thing you must not do, ever since Beavis vs parkingeye case, is just ignore it. That was the old advice and used to be sound but these days you can get a CCJ. Each ticket / firm needs looking at

2. You stayed too long in a restricted car park

Many car parks, particularly at supermarkets and service stations, allow you to stay for a limited time without paying, usually about 2 hours. This is intended to be enough time for you to do your shopping.

The car park is usually managed by an external parking management company, such as Parking Eye or Civil Enforcement Limited.

If you stay for too long, you have to pay a significant charge. The way they catch you is by using Automatic Number Plate Recognition (ANPR). This technology can record what time you arrive in the car park and what time you leave.

There have been questions raised about whether it’s legal to issue parking charges in this way. In fact, the legality was challenged in the Supreme Court in 2015.

To the disappointment of many motorists, the court decided that, provided the signs at the car park are clear and the charge is not too high, the parking management company is allowed to issue parking tickets to people who overstay.

If you received a parking ticket, you may have difficulty defending yourself against any claim, unless you can prove that the signage was not sufficiently clear.

Thanks for that, that is the advice I can remember doing the rounds a while ago so that is useful.

I am pretty resigned to my fate in all honesty.... but my thought was to have a drive over today and see what the signage was like as a last resort.

Who is the car park for? Is it a supermarket car park? I had one not long ago for overstaying in a supermarket car park. They had a FAQ on their website because it's obviously a regular question they get. They had a claim form where I entered the details of the PCN, including receipts to show I had shopped there. They then got it cancelled. They don't mind customers over-staying but they probably won't help if you were just using their car park and not shopping there.

In fact, if you go to MSE, they will say the first thing you should do is contact the retailer before you do anything else anyway.

No unfortunately not the supermarket car park. Its opposite Tesco, and is for a strip of smaller shops, bookies, chip shop, vets etc I think.

£60 now or £100 if not paid within 14 days.

My fear is I think there is a second one on the way as a couple of days later I used the car park again - just not sure how long for! 😂

My Mrs nearly got caught out when visiting the optician a few weeks ago. It’s recently introduced and wasn’t properly operational a month ago. If you were there to visit one of the businesses ( why else would you be?) then go and talk to them they can put your number ro the management company as being one of their customers and therefore exempt, that what happened to Mrs Flash.

If you can afford it just pay it. I find these things eat up more of your energy and time than half a night out.

To be fair one of my visits was to pop into the leisure centre for some info actually but I couldn't get parked in the car park - but I'm hoping that wont have reached the 30 min mark.
