Withdraw Statement !!!

Can you withdraw a statement made to the police?


CPS still going ahead with the trial !!! Its his word and others word's but no clear evidence of him breaching a court order.



If there any offence on the thread please Admin can you remove this, in the past you would not allow things like this being on the forum.

You can withdraw a statement at any time however the case can still go ahead if the police and CPS think they have enough evidence.

the big thing to think about is if you will get into trouble yourself by doing so.... wasting police time etc.

Highly likely he won’t get done for wasting police time - people can make statements and then withdraw for all sorts of reasons. but much more likely he could end up being summonsed to court if the CPS are intent on proceeding and need his evidence to prove the case.
 
You can withdraw a statement at any time by contacting the CPS. You are not committing an offence by doing so, unless you lied on the original statement.

The CPS will want to know why you are withdrawing a statement, but it is your right to do so if you want to.

Assuming the original statement does not contain lies, you are not wasting police time and there are no legal ramifications, other than for the defendant, who may not end up going to trial, of course.

Contact the police, not cps.
 
If the CPS already have the case then you are better contacting the CPS directly, they will handle it, not the police. It directly effects their decision on whether to bring a prosecution or not.
Sorry but that’s wrong. They would tell him that he should contact the police who will go out, take a statement and forward it to the CPS.

I guess whatever you found on ‘a solicitor website’ trumps what I know from having practiced criminal law for 13 years and dealing with these requests on a daily basis. I don’t see where it says they are better contacting the CPS directly?
