Anyone been sued for breach of employment contract?

Been an interesting day today, he's acting like a spoilt brat, phoning me at my desk after looking at the camera feed in our office, nitpicking and being passive aggressive. The whole pattern over the last few weeks has been harassing so I'm going to lodge a grievance against him.

Yes we have one, not sure how it helps.

It's a shame, I've mostly enjoyed working there over the years but there's been a lot of change and some nasty situations. I've tried to stop the rest of my team doing anything rash and stupid bit they've had enough, the boss gave me a dressing down after the first lad put his notice in which led to me putting mine in, now the last two lads have followed suit and are going with the first lad, again i tried to calm everything down but I keep getting the blame and the crap for it All.

In fairness, if you take out a grievance that will help.
Whistleblowing is good for making a little more ‘noise’ - ‘bullying’ claim for instance.

Years ago I worked a three month notice period before starting a new job.

A few months after I left my old boss left too. He also had a three month notice period, but told the company he was leaving and worked a week.

He was in breach of contract but to pursue it through civil courts is timely and costly, so it was never pursued.

When I worked in Aberdeen it wasn’t uncommon for people not to work notice periods. Some agreed a reduced time with their employers and others just left.
 
Millbrook's advice is right. If you and the employer agreed you would leave before the notice period, then that's fine. You should send a letter saying that was the case. HOWEVER If there were no witnesses then proving what was said might be hard, and your employer might deny the conversation.

Your employer might say the person to whom you resigned did not have authority to accept your resignation, or that it might adversely affect the operations of the company, or that you have trade secrets, or confidential information about the company. If any of this is true they might put you on garden leave for the length of your notice. Most firms will not let you take holiday leave as part of your notice.

What I would not advise is pretending you are sick, or just not turning up for work. You may find they get an injunction to stop you working for the new company. The last thing you need when joining a new firm is a three party legal punch up.

If it turns out your employer denies letting you quit without due notice then you may have to work the extra time. Yes it will be a pain but your reputation will not suffer and your new employer will realise you are reliable, even if they have to wait for your services.
 
He would be unwise to try to prosecute you not least because the employer virtually never wins regardless of the rights and wrongs.
 
Update: I left last week, I was going to have a face to face with them about it but he rang me at my desk spouting a load of passive-aggressive ***** about what he'd seen on the cameras in the office (which was actually me and one of the lads getting stuff ready for a job the next day). I stewed on it overnight then called him the next day to tell him I would be leaving at the end if the following week as I wasn't going to put up with continued harassment for my remaining time.

There was some closed door meetings but they gave me my final pay and P45 and he rang me on my last day to say thanks for my service blah blah blah. And that he hoped the new job was challenging enough for me.

I did as much of a handover as I could with the new guy Who didn't seem all that interested but that's the end of that chapter. Apparently the door is still open if I decide I want to go back, I don't think so.

Thanks for all the advice everyone. Ultimately I think it came down to me standing my ground and him being a stubborn prat worked against him.
