Working your notice Period

Have you ever left a job without working notice period?

Recently I got a new job but have since been offered a new one which is more suited to me and a lot more money with an immediate start date, I have informed my employer about this and they want a resignation and for me to work my one week notice period which is in my contract. However I have heard through the gravepine their has been a few cocky remarks about my imminent departure ‘ he has done all his training and now he’s ****ed off, that’s money we will never get back’ that was from my line manager.

It has made me feel crap about going in next week. I really don’t want too, would rather spend days with my son or start the new job.

Look forward to hearing people’s thoughts on this.

They could in theory take you to court for breach of contract. However that is time consuming and costly so an unlikely option. I once left a role with a 12 week notice period after 6 weeks. I just talked to my employer and we agreed a mutual arrangement.

It might be worth phoning ACAS for their advice but I suspect they'd say something similar to me.

I have only been there less than a month but suppose if that is a real option then guess I’m best working it. It’s just I feel ***ed off with a couple of things I have heard.

If they`ve trained you at their own expense and not written some sort of monetary claw back if you leave within a certain time period then that`s on them, not on you

You`ve stuck to the T&C's, go in with your conscience clear, work your contracted hours and the week will fly.

You could raise the issue with HR, as the comments have come from your Line Manager, that will waste the best part of your weeks notice. They may even send you home

What is the worst that could happen?

Sounds like a company that will be used to having a load of churn so don't take it personally, those comments will be made every single training intake.

I'd be amazed if they take any action if you don't work your notice.

On the other hand I guess they helped you out by giving you a job and it's only a week so if you leaving early would leave them short - rather than you being made to do it as a punishment - then it might be worth staying the week?

No right or wrong answer to your predicament, it all boils down to your personality and what you are best suited to doing.
Many people would go sick, for me I would go in with my head held high and do the job to the best of my ability safe in the knowledge I was moving on to bigger and better things.

How much unused holiday have you accrued? You might be able to take some of your notice period as annual leave.

I’d bite your tongue and go in and keep your head down . Be awful if anything bit you on the backside in the future re references , word of mouth between gaffer/ acquaintances in the pub Etc.

good line in life is .........always be dignified to people you pass on the way up as you may well be meeting them on the way down .

Are you in a probation period? - does the notice apply during probation

Could you take the week sick? Stress/anxiety related due to what you’ve heard said about you?

personally it’s a week and the company you are going to would have expected a notice period

You should have accrued at least a day and a half in holiday... bang that in for the end of the week and you are down to 3 and a half days.

if you have any liu time then get that used too.

otherwise just get your head down and work it off. You never know when you might meet them in the future so it’s best to go with your slate clean

Go in and have an honest conversation with the person who you heard saying it and anyone else who's important there and explain you understand how they might feel disappointed that you are leaving and you are grateful for the opportunity to work there.

However you have a young family and an opportunity has a risen paying much more money and you have to put your family first and you wish to them all the best.

From what you`ve said I think the worst that could happen is if it you let it affect you

Like others have mentioned here comments get made all the time and given it`s a week you only need to work minus anything you have accrued, the best course of action is try to ignore the snide comments and finish the week out with your head held high.

Can’t say fairer than that. 👍🏻

You know what as well. Work colleagues are the most cynical people in the world so take the comments with a pinch of salt

Next time someone is off work sick, see how many people genuinely believe it

Yeah they never believe it do they. Never any genuine sympathy on return either.
