To be fair, that’s basically been the position of every US president when it came to “international law” since Harding won the 1920 election with his "covenant of conscience" argument against US membership of the League of Nations. If it ain’t US law, it doesn’t bind the US.

There are two issues with Trump. The less concerning one, that he uses profoundly undiplomatic language to express this. And the more concerning one, that he doesn’t appear to think US law applies to him either.

And SCOTUS in Nixon v. Fitzgerald eventually agreed with him of course. The principle didn’t save his presidency. That was because we had a less partisan Congress in those days that was prepared to act against excesses. I shouldn’t have specified Trump. All US citizens are immune from international law as far as US presidents are concerned. No president has ever considered signing up for the ICC. Congress has basically committed the US to go to war if the ICC should even try.
