Refund advice needed - legal bods

So long story short. TUI have paid back a deposit for a holiday in 2021 that was moved due to covid. they have now rang me saying that it shouldn't have been paid back and that i owe them the deposit back. is this right as when they refunded they told me that the holiday hadn't been set up in time due to stores being closed and that we were due the money back off the account.

Tell them you'll see them in court if they want their money.
 
i was thinking that. their mistake. can't find anything on the net about it other than cases where people are paid money that is not theirs then it is "recovered" such as people being paid twice accidentally etc.
 
So was the holiday supposed to be this year, and they moved it to next year? But have since given you your deposit back?

if you don't want the alternative dates then tell them it's not your problem and keep your money.

I doubt they'd take you to court over the loss of a deposit. Don't pay them.
 
yeah that's what i was thinking. the holiday was this year (florida) and we then moved to a different booking next year
 
I think they will be bankrupt before they get their day in court. We live in unusual times but this seems like very odd behaviour, are you sure it’s not a scam?? If not a scam then I would just tell TUI, I’m sorry it’s your mistake and as I am not having a holiday based upon your advice I will not be paying the deposit back to you.

Do you now not want the rebooked holiday? Are they simply saying you need to pay the deposit for the holiday for 2021. If you have moved on and then booked elsewhere I wouldn’t do anything.
 
If you still want the holiday next year what's the problem with paying the deposit?

If you don't want the holiday at all then yes you should get a refund.
