Receiving a speeding ticket more than two weeks after the offence.

Can anyone give me a bit of advice?I was clocked at 58 in a 50 zone on the M1 last month near Sheffield in a roadworks area. It was in a works vehicle. The letter to my employer asking for details of the driver was dated 20 days after the alleged offence. Looking online it seems that it should be sent in 14 days of the offence otherwise it isn’t valid. Any tips folks?

You’re meant to receive the NIP within 14 days of the offence where you’re meant to provide details of the driver at the time, if you haven’t received it within that time you shouldn’t be prosecuted. I’d presume if the NIP is dated 2 over weeks after the offence stated it would be a clear cut situation and would be thrown out.

Thanks. The offence was may 23rd and the date on the letter to my employer was June 12th.

How long do police have to send a speeding ticket?

The police must send the actual speeding ticket, i.e. the Fixed Penalty Notice, within six months of the date of the offence. They can only send the speeding ticket if they previously sent the Notice of Intended Prosecution within 14 days.

When you look online for how long the police have to send a speeding ticket, you’ll find lots of answers stating 14 days. However, these answers are confusing the Notice of Intended Prosecution with the actual speeding ticket. Yes, the NIP must be sent within 14 days, but once that has been returned and the guilty driver identified, the Fixed Penalty Notice has to be sent within six months.

The first NIP has to be sent to the Registered Keeper within 14 days. Late NIPs used to be an occasional occurrence, but they simply don't happen any more; I believe there's a block in the system now to prevent them being sent out if they're too late.

If your employer got the NIP after 20 days, you can pretty much guarantee that they have leased the vehicle, the finance company is the RK, they got the first NIP within 14 days and replied with your employer's details, and what you've seen is a follow-up.

That’s a good point. Bummer.

Yep same here. Except my company sat on it for over 4 months until Humberside Police threatened them. By the time it got to me speed awareness was no longer an option and I had to take a fine and 3 points.

I was driving a rental van and got caught by a speed camera.
It took a while for the summons to get to me, as they got my details from the hire company and also I was moving home.
In the end like others, I wasnt offered the course and had to take the 3 points, with the resulting increase in insurance premiums etc. It is a bit of a stitch up.

It’s not really a stitch up is it?
You didn’t have to speed.

Same happened to me, it took about 6 months for me to get the letter but I was still able to do the course. Lease company was sent the NIP, it then got sent to my employer eventually and then whoever manages the fleet then gave them my details. But each time that timer starts ticking again until the real driver is identified.

I was fuming because the time I was driving down, I was dying of the worst cold and both the girls with me said they didn't feel confident driving so long so it was left to me, and neither offered anything towards it.
