Parking Eye fine

Need a bit of help here guys. last Saturday, my wife picked me up in Stockton at the Dovecote St car park over the road from ARC. I have since received a letter from Parking Eye notifying me off a £100 fine for entering the car park and waiting there for 5 minutes. There was either 1 or 2 other cars in the car park at the time. I am sure that I have seen some posts on this forum that could direct me to some sort of car park appeals website. I have appealed direct to Parking Eye but dont hold out much hope with it and really do think it is grossly unfair so any help/advice would be much appreciated! Thanks everyone UTMB!!

£100 seems steep, does it drop to £50 if you pay within a certain timescale ? unfortunately if there’s clear signs about the 5 minutes and you stayed longer than this then you’re bang to rights.

Ignoring it isn’t a good strategy anymore and not an option to you anyway as you’ve already acknowledged your penalty by appealing.

Whilst frustrating I think you’ll have to pay.

Was the car park for where you were visiting? Try calling them they may be able to get them to drop it.
I had an issue with these shysters for months even though I had paid for my parking but because I hadn’t put my reg in I was being fined £100.
I still had the ticket & I proved the machine was faulty as all the other machines in the car park wouldn’t issue a ticket unless you put the reg in. They were not going to let it go I just kept saying see you in court in the end the answer was so simple the car park we used was for a hotel where we were going to dinner I rang them & told them what parking eye were doing.
They rang parking eye & told them to drop it the hotel knew which ticket machine it was apparently they have been asking for it to be repaired for a couple of years because they get so many people ringing them being fined for visiting the hotel.
I have heard since they kicked parking eye out because of how they were going on with their customers it was out of order really they will probably have made a fortune out of doing stuff like this up & down the country.

It’s a bit of a tricky one. I’m trying to find a Facebook post I seen the other day, in which someone took a wrong turn in a town they didn’t know, and entered a car park monitored by Parking Eye, they then received a fine for spending something like 2 mins 27 seconds whilst in there, As they where checking the sat nav before leaving. They are contesting, but some people are saying that coz the car was stationary for a period of time (approx 1 minute) it’s classed as parking..bit harsh I think.

It drops to £60 if you pay within a certain time period Alzi. What annoys me is that this was at 8 o'clock at night , the town was dead. So annoying!

The car park was just a handy pickup point Juan, nothing to do with where i was visiting unfortunately.

Too right it's harsh mate. This sort of thing just shouldn't be allowed!

Listen mate the short answer is that you pay it or you fight it. There's a good chance you'll win but it will take some hassle putting together a suitable and relevant defence. You should never use a template one but you can put together a relevant defence based on a number of templates that relate to your case.

There is another option which is to pay £20 to a company that fight these on your behalf with a guarantee to pay your costs if they aren't successful. One of the most reputable as far as these things go is http://privateparkingappeals.co.uk/

I have no link to this company at all other than to have used their services previously. The guy who set the company up was a guy asked John Wilkie who acted as a volunteer legal rep for the ordinary man in courts versus cowboy companies up and down the country in literally hundreds of cases. He was incredibly successful.

Unfortunately he lost his battle with Cancer last week but as far as I know the business has been self running for some time so isn't affected.

Whatever you do, DO NOT IGNORE THIS. Parking Eye are the single most litegous company in the country.

It seems like a genuine mistake you've made and whilst it seems like you're technically in the wrong these companies are total cowboys. They cheat, they lie and they target people as much as possible.

Good luck mate

A private company cannot issue a "fine" only an invoice, ignore it, they didn't chase me when I ignored one from scarborough, I was 2 minutes late back to the car and there was no facility to pay an excess charge so I just ignored the letters.

I may be wrong here but I am sure that the government introduced legislation that gave you 10 minutes leaway before a ticket could be issued. If that is the case then your wife could wait 15 minutes before incurring a penalty.

It is worth checking out.

I got done by one of these companies a couple of years ago. Our classes advice, who is a copper, was to ignore it as they have no real authority to fine you and rely on fear to make people pay up. Got a stream of letters threatening all sorts for 3 months then never heard from them again.

Except this is the single most litegous company in the country and they do take people to court by the hundreds every day.

Its not a scare story. There was indeed old advice that was absolutely right to ignore them. It can still be done with companies that don't ever follow through with threats but these guys do.

It's a little old now but here's an article - https://www.theguardian.com/money/2017/aug/26/parking-eye-takes-on-top-barrister-85-fine

"Consumer website Parking Prankster claims the company is launching up to 1,000 court cases a week, often to recover very small amounts of money. Many come from land controlled by hospitals and large supermarkets."

If you ignore this then your an idiot. You shouldn't give crappy advice on leagl matters when you don't know what you're talking about; no matter how well intentioned.

Fair enough, like I say it was years ago. Cant even remember company name tbh.

As for your snarky last paragraph, no need to call anyone an idiot. And if the fellas wants proper expert legal advice then a football message board ain't the place for it.
